The Terms of Use and Privacy Policy will be defined below \u2013 the &#8220;Terms of Use&#8221;.<\/p>\n\n<p>Important to know!<br \/>Using the site&#8217;s services or any part thereof (including browsing, subscribing to newsletters and purchasing tickets via the site) will constitute your agreement to the Terms of Use.<br \/>If you do not agree to the provisions of the Terms of Use or any part thereof, do not browse the site and do not use its services in any way.<br \/>The violation of the Terms of Use and\/or any commitment by the visitor as specified in these Terms of Use may lead to blocking access to the site, in addition to any other rights the Museum of Tolerance has under the law.<br \/>The above constitutes an integral part of the Terms of Use.<\/p>\n\n<p><strong>Introduction<\/strong><\/p>\n\n<p>1. AD\/WB YMuseum Corp (Ltd) (private) (company No. 560036659) (hereinafter \u2013 the &#8220;Museum of Tolerance&#8221;), develops and operates the site. The site is located and operates under a domain name owned by the Museum of Tolerance, written at https:\/\/motj.org.il, or any sub-domain name (hereinafter: the &#8220;Site&#8221;). In addition, the Museum of Tolerance operates content environments within other platforms, such as Facebook, Instagram and YouTube (hereinafter: &#8220;Content Environments&#8221;), and all that is stated in these Terms of Use shall apply equally to the use of these content environments and to all content displayed there.<br \/>2. The above and below apply to every visitor on the site, and the use of masculine form is for convenience only.<br \/>3. The section headings in these Terms of Use are for convenience and should not be construed as mandatory or helpful in interpretation.<br \/>4. The Terms of Use apply to any use of the site, whether via the Internet or by any other means. Also, the Terms of Use apply to the use of the site in any form via computers or any other device, including mobile phones, handheld devices, and so on.<br \/>5. These Terms of Use apply to all content displayed on the site, even if displayed via a deep link from another domain.<br \/>6. The Museum of Tolerance reserves the right to amend and\/or deduct and\/or add terms to the Terms of Use and to block or limit, without prior notice, access to the site, at any time. You should check the site, from time to time, the legal notices appearing on it and other additional terms, as they bind you.<br \/>7. The Museum of Tolerance may determine that the use of the site&#8217;s services or part thereof is conditional on payment, as indicated in the body of the site next to each paid service. Different terms concerning payment, which may appear near the service as described, are also an integral part of these Terms of Use.<br \/>8. In addition to the definitions appearing elsewhere in these Terms of Use, the following definitions shall apply:<br \/>8.1. &#8220;Visitor&#8221;\/&#8221;Visitors&#8221;\/&#8221;User&#8221;: any person browsing the site, whether paid or free, whether with the consent of the person responsible for the visitor or without consent.<br \/>8.2. &#8220;Customer&#8221;: a visitor who purchased a service or product via the site.<br \/>8.3. &#8220;Responsible&#8221;: his parents or guardian of a minor or incapacitated visitor<br \/>8.4. &#8220;Content&#8221; or &#8220;Contents&#8221;: any information of any kind, including any message, verbal, visual, audio, audiovisual content, and any combination thereof, as well as their design, processing, editing, distribution and display method, including (but not limited to): any image, photograph, illustration, animation, diagram, figure, rendering, sampling, video, audio file and music file, software, file, computer code, application, format, protocol, database and interface and any symbol, sign and icon.<\/p>\n\n<p><strong>General Terms and Rights in Content<\/strong><\/p>\n\n<p>9. Unless explicitly stated otherwise, all copyrights and all other intellectual property rights in all materials, contents and information on the site (including, among others, the site name, photographs, illustrations, logos and more) are owned solely by the Museum of Tolerance or by those who licensed its use of these materials. Merely granting access or use of the site does not confer or transfer to the user or any third party any ownership, use, intellectual property rights or any other rights; it is hereby clarified that all rights and ownership of this site, its materials and contents, in all its various aspects, are exclusively owned by the Museum of Tolerance and\/or its affiliates. The site is protected by copyright laws and by any applicable law. If you violate these Terms of Use or the terms appearing on the site, the license to use the site will terminate immediately. All rights reserved to the Museum of Tolerance.<br \/>10. The Museum of Tolerance and\/or the associated bodies, as applicable, may use software, content and information as described at their sole and absolute discretion, anywhere and in any manner, without any restriction, and without the need for any approval or payment of consideration, including to sell, transfer, copy, modify, use, display publicly and grant secondary licenses for such content or part thereof, subject to the provisions of law.<br \/>11. A visitor who finds that content and\/or information and\/or a link uploaded to the site violates their rights, shall inform the Museum of Tolerance of the breach by contacting info@motj.org.il. The visitor&#8217;s notification shall include precise details about the visitor \u2013 full name, postal address, email address and phone number, in a manner that enables identification and contact.<br \/>12. The Museum of Tolerance may, at its sole discretion and at any time and without prior notice, adjust and\/or suspend and\/or terminate and\/or modify and\/or restrict the site&#8217;s services, the information appearing therein, site contents \u2013 all or some \u2013 including access permissions, availability of activities and services, various contents, operating hours, content, as well as software and\/or equipment required to access the site and its services. The Museum of Tolerance reserves the right to restrict certain activities and\/or access to all or some of the site&#8217;s services, for a given visitor or in general. In any case, the Museum of Tolerance shall not be liable for damages of any kind as a result of the above, even if it foresaw or could foresee such damages.<br \/>13. The Museum of Tolerance may change and\/or correct and\/or erase and\/or add conditions to these Terms of Use or part thereof at any time, at its sole discretion and without prior notice. The changed and\/or corrected Terms will be published on the site and will be in effect from the moment of their publication.<br \/>14. The Museum of Tolerance may offer, at its sole discretion, special activities and content subject to special or different terms to be brought to the attention of the visitors or part thereof. It is hereby clarified that participation in the aforementioned special activities or exposure to the special contents will be deemed as consent to the special terms, which will be as detailed as possible near each such special activity.<\/p>\n\n<p><strong>Visitor Declarations and Commitments<\/strong><\/p>\n\n<p>15. The visitor to the site declares and undertakes as follows:<br \/>15.1. He is over 18 years old and authorized to enter into this agreement, and if he has not yet reached 18 or is incapacitated, his agreement to this contract is made with the consent of the person responsible, and if he is a corporate entity, it is legally registered.<br \/>15.2. He and all his authorized users will comply with these Terms of Use in full and\/or with the law or with the Museum of Tolerance&#8217;s directions, within their use of the site, and the visitor will be responsible for the use of the site by any person acting on his behalf.<br \/>15.3. Any information he provides to the Museum of Tolerance or to any other party for registration and\/or purchase and\/or as required anywhere on the site, including credit card data, and any information he may publish and upload will be true, accurate, consistent with reality and not misleading.<br \/>15.4. That he will be responsible for any damage caused to the visitor and\/or any third party as a result of reliance on the contents displayed on the site and\/or via it, and that he knows that the Museum of Tolerance will not be liable for any direct and\/or indirect, monetary or other damages arising to visitors and\/or third parties as a result of using the site and\/or reliance on the content appearing therein. The above applies even if the Museum of Tolerance or its affiliates could foresee the damage in advance.<br \/>15.5. That he knows that personal details he provides, if provided, will be stored in a database, as detailed in the privacy policy below and in accordance with the law.<br \/>15.6. That he knows that the Museum of Tolerance does not provide any equipment and\/or infrastructure required to access the Internet and to receive the site&#8217;s services, including telephony devices, modems and Internet access software.<br \/>15.7. Not to copy and\/or \u201cdownload\u201d and\/or distribute and\/or sell and\/or trade and\/or modify and\/or process and\/or publicly display and\/or use the site and\/or its contents in whole or in part, unless he has obtained the Museum of Tolerance&#8217;s explicit written consent in advance. The visitor declares that he is aware that the Museum of Tolerance may be obligated to pay third parties for violating this clause by him, and he undertakes to reimburse and\/or compensate it promptly for any amount the Museum of Tolerance is required to pay to a third party as stated, including legal costs and lawyers\u2019 fees actually incurred by the Museum of Tolerance as a result. The visitor also agrees in advance that in the event of violation of this clause by him, the Museum of Tolerance will be entitled to obtain from any Internet provider and any other party identifying information about him.<br \/>15.8. Without prejudicing the provisions of section 19.7, all &#8220;downloads&#8221; and\/or copies and\/or any other use, if approved by the Museum of Tolerance, shall be done with a note that the matter was done with the Museum of Tolerance&#8217;s approval and that all rights are reserved for the Museum of Tolerance.<br \/>15.9. Not to use the site&#8217;s services and\/or content appearing therein outside the site and\/or in violation of these Terms of Use and\/or law and not to use the site&#8217;s services for profit or commercial purposes.<br \/>15.10. To compensate and\/or indemnify immediately upon first demand the Museum of Tolerance and\/or any party whose content is included on the site and any licensee and\/or other rights holder on the site for any damage caused to them due to a breach of the Terms of Use. If a legal action and\/or any other proceeding is brought against the Museum of Tolerance in connection with a breach of the Terms of Use by a visitor, the Museum of Tolerance reserves the right to manage its defense itself in the proceedings and the visitor undertakes to cooperate with the Museum of Tolerance in any such legal process.<\/p>\n\n<p><strong>Newsletter Subscription<\/strong><\/p>\n\n<p>16. Any visitor aged over 18 (including companies and corporate entities) will be entitled to register for the Museum of Tolerance&#8217;s newsletter service \u2013 mailings that will be sent from time to time by the Museum of Tolerance and will include information, updates and various announcements regarding the Museum of Tolerance&#8217;s events, exhibitions and special projects (hereinafter: &#8220;The Service&#8221;). Registration to the service is free.<br \/>17. A visitor who joins the service accepts all these Terms of Use and commits to act in accordance with them.<br \/>18. By registering for the service from the Museum of Tolerance&#8217;s site, the visitor gives his consent to these Terms of Use, including the use of his details and their inclusion in a database as detailed in this document.<br \/>19. By subscribing to the newsletter from the Museum of Tolerance&#8217;s site, the user agrees that the Museum of Tolerance may, in accordance with all applicable law, transfer his details to other bodies for the purpose of tailoring and improving the service terms, provided that the third party receiving the data will not use it beyond what is permitted by law, will maintain confidentiality, and will not transfer them to another party without the Museum of Tolerance&#8217;s consent, and that the users&#8217; privacy will not be harmed. The user agrees to the use of the data as described and confirms that its use will not be considered a violation of user privacy and will not entitle him to any remedy or compensation. The user may revoke this consent by giving written notice to info@motj.org.il. In the event of such revocation, the Museum of Tolerance may, at its discretion, cancel the subscription.<br \/>20. Each user of the service may cancel their subscription at any time by clicking the &#8220;unsubscribe&#8221; link appearing in each newsletter sent by the Museum of Tolerance.<br \/>21. The Museum of Tolerance may refuse to admit a person to the newsletter service at its discretion and without obligation to justify the refusal.<br \/>22. The user is responsible for informing the Museum of Tolerance of changes to their personal details to ensure continuous and proper contact. The Museum of Tolerance will not be responsible for failure to receive the service due to the user&#8217;s failure to update personal details.<br \/>23. The Museum of Tolerance may decide at any time to discontinue the service.<\/p>\n\n<p><strong>Event Content Discovery and Booking<\/strong><\/p>\n\n<p>24. The site offers online purchase of tickets for exhibitions and\/or events at the Museum of Tolerance. It is clarified that the products are sold not by the Museum of Tolerance, but by the company &#8220;SmarTicket&#8221; (the &#8220;Ticket Company&#8221;), which is responsible for operating the site&#8217;s sales system (order receipt, processing, charging, shipping and related matters). A visitor who chooses to purchase tickets online will be subject, in addition to these Terms of Use, to the Ticket Company&#8217;s regulations and will be asked to confirm their agreement to the Ticket Company&#8217;s regulations at the time of purchase.<br \/>25. Online ticket purchases will be available to visitors only if they are 18 years or older. These purchases will require providing the details as required to complete the purchase. For clarity, all the details the visitor is asked to provide will go directly to the Ticket Company, and the Museum of Tolerance bears no responsibility for how the Ticket Company uses these details. The visitor understands and agrees that the Museum of Tolerance&#8217;s privacy statement published on the site does not apply to the Ticket Company and the Ticket Company may use the details transmitted to it, not in accordance with the Museum of Tolerance&#8217;s privacy statement.<br \/>26. The visitor undertakes to provide, at the time of the ticket order, all required details fully and accurately. Without limiting any other remedy available to the Museum of Tolerance under this agreement or any law for providing incomplete and\/or inaccurate details, if the visitor provides incomplete and\/or inaccurate details, the Museum of Tolerance shall not be liable for any issue with the ticket order and\/or its delivery to the visitor.<\/p>\n\n<p><strong>Cancellation of a Transaction<br \/><\/strong>27. The customer may cancel a ticket purchase for entry to events and tours at the Museum of Tolerance made through the site within 14 days from the day of the transaction or from the date of receipt of the document containing transaction details \u2013 whichever is later, provided the cancellation is made at least 7 business days before the date specified on the purchased tickets or the start date of the relevant activity.<br \/>28. Notwithstanding the foregoing, a customer who is a person with a disability (as defined in the Equal Rights for Persons with Disabilities Law, 1998), an elderly citizen (over 65) or a new immigrant (who has not yet been five years since the issuance of the immigrant certificate or eligibility certificate as an immigrant by the Ministry of Immigration and Absorption), will be entitled to cancel a transaction within 4 months of the transaction date or the date of receipt of the document with the transaction details, whichever is later, provided the cancellation is made at least 7 business days before the date specified on the purchased tickets or the start date of the relevant activity. An additional condition for cancellation is that the engagement between the Museum of Tolerance and the otherwise mentioned user included a conversation, including through electronic communication. In such a case, the Museum of Tolerance may require the customer to present a document proving that they are a person with a disability, an elderly citizen or a new immigrant (as applicable), in accordance with the Consumer Protection Law.<br \/>29. In the case of such cancellation, the Museum of Tolerance will refund the customer within 14 days from the date of receipt of the cancellation notice, for that portion of the transaction price paid by the customer, cancel the customer&#8217;s charge for the transaction (if not yet charged) and provide the customer with a copy of the cancellation of charge notice as stated.<br \/>30. Without prejudice to the foregoing, an order may be cancelled also within the 7 business day period before the date of the ticket or the start date of the relevant activity; and in the case of such cancellation:<br \/>30.1. Cancellations made 3 to 7 non-working days before the visit will incur a charge of 50% of the total transaction cost.<br \/>30.2. Cancellations made less than 72 hours before the visit will incur a full charge of 100% of the total transaction cost.<br \/>31. A cancellation notice may be delivered to the Museum of Tolerance in any of the following ways:<br \/>31.1. Orally (by telephone at 073-334-2780 or in-person at the Museum of Tolerance offices).<br \/>31.2. By registered mail to: Hall 33, Jerusalem.<br \/>31.3. By email: reception@motj.org.il.<br \/>31.4. Via the dedicated link to submit a cancellation notice on the site\u2019s homepage.<br \/>32. The cancellation notice must specify the customer&#8217;s name and identity number. In addition, to expedite handling, it is recommended to also state the cancellation reason, order number, and any other relevant details regarding the order in the cancellation notice.<br \/>33. Any monetary credit will be transferred to the credit card or payment method used for the order only.<br \/>34. The Museum of Tolerance may cancel an activity for any reason it deems appropriate, with reasonable discretion under the circumstances, including force majeure, governmental restrictions (including in relation to pandemics) and unexpected technical problems. In such a cancellation, the Museum of Tolerance will refund the customer the amount paid for the activity without deduction of a cancellation fee. It is clarified that the user will not be entitled to any further remedy for such cancellation.<br \/>35. Events, activities and tours held at the Museum of Tolerance or organized by it may be filmed on video or still photography by the Museum of Tolerance or its affiliates. The Museum of Tolerance may use these images for marketing, PR and advertising purposes, in any media, including the website and the Museum of Tolerance&#8217;s social networks.<\/p>\n\n<p><strong>\u05de\u05d3\u05d9\u05e0\u05d9\u05d5\u05ea \u05de\u05d5\u05d6\u05d9\u05d0\u05d5\u05df \u05d4\u05e1\u05d5\u05d1\u05dc\u05e0\u05d5\u05ea \u05d1\u05e0\u05d5\u05d2\u05e2 \u05dc\u05ea\u05d5\u05db\u05df \u05d5\u05de\u05d5\u05e2\u05d3\u05d9 \u05d0\u05d9\u05e8\u05d5\u05e2\u05d9\u05dd, \u05d0\u05d9\u05e1\u05d5\u05e3 \u05db\u05e8\u05d8\u05d9\u05e1\u05d9\u05dd \u05d5\u05db\u05e0\u05d9\u05e1\u05d4 \u05dc\u05d0\u05d9\u05e8\u05d5\u05e2\u05d9\u05dd<\/strong><\/p>\n\n<p>36. For free events:<br \/>36.1. The Museum of Tolerance reserves the right to limit ticket numbers according to the event&#8217;s nature, and also the number of tickets allocated to each purchaser for a particular event.<br \/>36.2. Pre-ordered tickets will be held for the purchaser at the Museum of Tolerance&#8217;s box office until 20 minutes before the event starts. If the purchaser does not collect the tickets by 20 minutes before the event begins, the tickets will be returned to the box office.<br \/>37. For paid events:<br \/>37.1. Reserved seats will not be held for the purchaser after the event starts.<br \/>38. For all events (both free and paid)<br \/>38.1. Entry to an event will not be allowed 20 minutes after the event begins. Notwithstanding this, the event manager may, at their sole discretion, decide in certain cases that entry to the event will not be allowed even just after the event starts and, in other certain cases, permit entry to the event even after 20 minutes from the start. <br \/>38.2. The Museum of Tolerance reserves the right to make changes to its content at any time (including content, date, time, location, duration of performance, artists and\/or actors appearing, etc.) without prior notice to the visitor and without the visitor being entitled to any compensation or remedy, except for a refund of tickets if one or more of the following conditions are met:<br \/>38.2.1. The event date has changed or the event was canceled.<br \/>38.2.2. The event start time changed by more than 30 minutes<br \/>38.2.3. A central figure among the event&#8217;s participants was replaced<br \/>39. In addition to the above, the ticket purchase terms on the site relating to the specific event shall apply.<br \/>40. The Museum of Tolerance reserves the right to decide when and by which method and\/or means (phone sales only, online sales only, sales at the front desks in the Museum of Tolerance building only), or a combination of them, tickets for a particular event will be sold.<\/p>\n\n<p><strong>Limitation of Liability<\/strong><\/p>\n\n<p>41. The site&#8217;s services are provided AS IS. The Museum of Tolerance does not warrant and will not be liable to the site&#8217;s visitors in relation to the quality of the services and\/or content on the site and\/or the availability of the services there. For clarity, it is hereby declared that the Museum of Tolerance takes steps to secure the site and protect visitors&#8217; privacy, in accordance with the site&#8217;s privacy statement as published from time to time on the site, but will not be liable for any security breach, fault or other defect, and the use of the site and its services is at the visitors&#8217; own risk.<br \/>42. The visitor is aware that some of the site&#8217;s services will be provided by other parties on behalf of the Museum of Tolerance. If this is stated on the site, the Museum of Tolerance will not bear any liability for the activities of those other parties.<br \/>43. Without limiting the above, the Museum of Tolerance will not be liable for content published on the site and\/or for services and\/or products and\/or deals offered by third parties including the content of advertisements, coupons and any commercial information appearing on the site, if any, or for any result and\/or damage due to their advertisement and\/or reliance on them and\/or use thereof. Anyone dealing with a third party as a result of on-site publications does so at their own risk, and the Museum of Tolerance will not bear any liability for this, even if it knew or should have known of the potential damage and\/or result described.<br \/>44. Advertising a notice and\/or coupons and\/or promotions on the site does not constitute a recommendation or encouragement by the Museum of Tolerance to purchase the services and\/or products offered therein, and the terms of any transaction concluded as a result of an advertisement, coupon, promotion or other information published on the site will be directly negotiated between the visitors and the advertiser and\/or the relevant supplier and at their own responsibility. It is clarified that the Museum of Tolerance has not reviewed the content published by a third party on the site and is not responsible for the foregoing. For clarity, the Museum of Tolerance is not, and will not be, a party to any such transaction. Visitors and subscribers expressly and unreservedly waive any claim or lawsuit against the Museum of Tolerance regarding the information, publications and contents as stated.<br \/>45. The site may contain links (links) to other sites, Israeli or foreign (hereinafter \u2013 &#8220;Other Sites&#8221;). The Museum of Tolerance is not responsible for these sites, their content or the services offered there. The Museum of Tolerance is not responsible for services on other sites and\/or any damage caused by them, including offense to the visitor. The Museum of Tolerance is not responsible for services and\/or products purchased and\/or available for purchase on other sites and\/or for data security and\/or how the visitor&#8217;s details are used on other sites. The presence of links to other sites on the Museum of Tolerance&#8217;s site does not constitute a recommendation to visit any of them, unless expressly stated. The Museum of Tolerance states that no steps have been taken by it to verify the accuracy or reliability of the contents included on the aforementioned sites, or the services and\/or products offered via such sites, or their suitability for such or other visitors. The Museum of Tolerance recommends carefully checking any other site before browsing it and\/or participating in activities offered there, and in any case \u2013 anyone who enters another site via a link from the Museum of Tolerance&#8217;s site does so at their own risk.<br \/>46. The Museum of Tolerance will not bear any liability for disruptions, faults, response times, viruses or any other factor that may disrupt or impair the site&#8217;s services and\/or cause any damages to users on the site.<br \/>47. The Museum of Tolerance will not bear any liability for damages caused to the user&#8217;s or subscriber&#8217;s computer system and\/or infrastructure, data loss, or any other damage arising from use of the site, including due to downloading data and\/or software via the site&#8217;s services.<\/p>\n\n<p><strong>Breach of this Agreement<\/strong><\/p>\n\n<p>48. Without limiting any other remedy available to the Museum of Tolerance under this agreement and\/or any law, the Museum of Tolerance will be entitled to take any action to prevent breach of the agreement and\/or repeated breach of the agreement, including blocking and\/or disconnecting a user and\/or restricting access to the site and\/or any other action that will prevent breach of the agreement and\/or reduce damages already caused.<br \/>49. In case of breach of this agreement&#8217;s terms, the visitor waives their rights under the Privacy Protection Law and\/or any applicable law that aims to protect their privacy and agrees in advance that the Museum of Tolerance will be entitled to obtain identifying information about them from any party, including Internet service providers.<br \/>50. The visitor shall compensate and\/or sue the Museum of Tolerance and\/or its representatives for any damages caused to them due to a breach of the Terms of Use.<\/p>\n\n<p><strong>Miscellaneous<\/strong><\/p>\n\n<p>51. These Terms of Use were last updated on May 20, 2025. The Museum of Tolerance reserves the right to add, change, delete and replace all or part of these Terms at any time at its sole discretion, without obtaining user consent or prior notice, except in the case of substantial changes requiring user notification. Substantial changes will take effect thirty (30) days after notice, unless the change stems from a legal or regulatory requirement, in which case the change will take effect under that requirement. The binding text of the Terms of Use is the Hebrew version as it appears on the site from time to time. It is the user&#8217;s responsibility to stay updated on changes to the Terms of Use, if any. Continued use of the site after such changes will be proof of the user&#8217;s consent to the changes.<br \/>52. Only the Museum of Tolerance may mortgage, convert, transfer or pledge its rights (including the right to receive payment from the visitors) and\/or its obligations under these Terms of Use, including all or part of the Privacy Statement, to any third party of its choice, without the user&#8217;s consent or advance notice, provided that the visitor&#8217;s rights are not affected.<br \/>53. The Hebrew and English versions of these Terms of Use, and any disputes arising from or related to the use of the site and\/or its contents, shall be governed by Israeli law and the competent court in Jerusalem, Israel.<br \/>54. These Terms of Use, as a binding agreement between the Museum of Tolerance and the visitor, supersede any previous written or oral representations, commitments or agreements.
