Privacy Policy

  1. AS W.B.C. Museum Corp (Private) (Ltd) 560036659 (hereinafter: “Tolerance Museum” or “the Museum“), operates the Tolerance Museum website at the address  https://motj.org.il (hereinafter: “the Site“).
  2. The Tolerance Museum attaches great importance to protecting the privacy of users on the site and does its best to safeguard the personal information it collects, holds and processes about site users. The privacy policy below describes the personal information that the Tolerance Museum may collect about site users as well as visitors to the museum in Jerusalem, the types of information collected, the purposes of collecting and processing the information, and the way in which a user of the site, as the data subject, can exercise his legal rights regarding the above information.
  3. The wording of this privacy policy is masculine for convenience and is intended for both women and men. [The reference in this privacy policy to the site user also applies to visitors of the museum in Jerusalem, with the necessary modifications and as appropriate]. for this privacy policy, “Personal Information” means any information or data relating to a user collected by the Tolerance Museum or provided to it by the user and/or by his authorized representative, in connection with or as part of use of the site and/or the services contained therein, including information by which the user can be identified directly or indirectly with reasonable effort, and/or information that is protected by the Privacy Protection Law, 1981 (hereinafter: “Privacy Protection Law“) (for example: first name, last name, ID number, residential address, mailing address, phone number, email, order/purchase history, museum exhibitions/activities in which the user participated, etc.). It is clarified that part of the information that may be collected about the user during use of the site does not personally identify the user and is not stored together with personal information, and cannot be used to identify the user with reasonable effort. This is statistical and/or aggregated information (for example: pages viewed by the user, time spent on the site or a page, type of device used to access the site, product pages the user viewed, etc.), and is not subject to the Privacy Policy.
  4. Providing any personal information by a user is not mandatory by law and not a prerequisite for browsing and using most of the site’s services, but without providing certain personal information, as required by the Museum, the Museum will not be able to offer or provide certain services, and the user may not be able to use all features, content and information offered on the site, including ordering products or services (in general or for certain products/services), joining the Tolerance Museum Members Club, etc. Accordingly, any disclosure of personal information to the Museum by the user is done of the user’s free will and with the user’s consent. It should be noted that personal information may be collected from the user directly, or by external suppliers who will perform the collection for the Museum (for example, via platforms of those suppliers embedded on the site such as SmarTicket, eventer, etc.).

If a user provides personal information about third parties to the Tolerance Museum, that user agrees and confirms that he has all the necessary approvals and consents to disclose the aforementioned personal information about those third parties to the Museum, and that the processing of the personal information will also be performed in accordance with and subject to this privacy policy. The user undertakes to indemnify the Museum for any damage arising from any claim or demand raised against him by any third party (or any other person) due to the use of this personal information.
  6. Personal information about a user will not appear on the site except with his explicit consent.

  8. Purposes.

The information, in whole or in part, will be used by the Tolerance Museum for the following purposes, all or some of them, as applicable:

  • Operating the site;
  • Ordering products or services offered on the site by the Museum and/or its affiliates;
  • For identification purposes (e.g., when contacting the Museum through the site or by other means);
  • Performing certain actions on the site;
  • Developing, improving and operating the site;
  • Streamlining internal organizational processes in the Museum, including in relation to the site and its use;
  • Adapting the site to the user’s personal preferences;
  • Contact, provide support, handle requests, inquiries and complaints and answer questions;
  • Analysis, research, control and statistics preparation;
  • Delivery of advertisements and marketing materials (subject to your consent under Section 30A of the Communications Law (Bezeq and Broadcasts), 1982);
  • Management of the Museum’s Members Club;
  • Use of photographs from the Museum’s events, tours and activities for marketing, advertising and communications purposes;
  • Defense against lawsuits, claims, suits and legal proceedings against the Museum and/or its affiliates, as well as against third parties;
  • Enforcement of the site’s terms of use and this privacy policy;
  • For compliance with the applicable law and legal and regulatory obligations of the Museum and/or its affiliates;
  • Any other legitimate purpose or interest of the Museum that aligns with the site’s terms of use, this privacy policy, and the relationship between the Museum and the user.
  1. Disclosures of Personal Data to Third Parties.

9.1. Personal data will not be disclosed to third parties, except in the following cases:

  • To provide services and products ordered through the site;
  • To the extent that the disclosure of personal information is required for the purposes set out in Section 8 above, including service providers and external consultants such as lawyers, accountants, support services, storage, cloud, computing/IT, banks, etc.;
  • To related companies;
  • If the Museum is required to do so by a court order, a request from a competent authority, or to comply with legal and regulatory obligations of the Museum (e.g., courts, law enforcement authorities, tax authorities, etc.);
  • If the Museum receives a notice to take legal action against it for actions by a user and in any dispute, claim, lawsuit, demand or legal proceedings, if any, between the user and the Museum and/or its affiliates;
  • If the Museum organizes its activities within another entity – including investment, acquisition, merger, reorganization or any other organizational change regarding the Museum’s activities within another entity – it will be entitled to transfer the personal data to the other entity, provided the other entity will undertake to abide by this privacy policy with respect to the user;
  • If a claim is raised or suspicion arises at the Museum that the user has committed an act and/or omission harming and/or potentially harming the Museum and/or its affiliates and/or any third parties;
  • For recruitment and placement purposes, including management of employment relationships (as the user may choose, for example, to apply for a job at the Museum via the site);
  • In any case where the Museum believes in good faith that disclosure of personal information is necessary to prevent damage to the Museum, to other users on the site or to any third party; and-
  • Upon explicit request by the user.

9.2. International transfers.

The Museum will be entitled to transfer personal information (in whole or in part) to third parties as described above, located in countries or jurisdictions where the level of privacy protection and information security differs from that in Israel. By using the site and providing personal information to the Museum, the user agrees that the Museum may also transfer personal information to the aforementioned third parties located in such countries or jurisdictions, or whose processing of personal information will be performed for the Museum in those countries or jurisdictions.

9.3. If the Museum wishes to share personal information of a user with any third party beyond the above, it will first contact the user and give him the opportunity to remove his data from the data repository, unless the user has already given his consent to use as described earlier.

  1. Other Websites.

The site may provide and include links to other sites that are not connected to the Museum, over which the Museum has no control, and the Museum is not responsible for the privacy policies of other sites to which links appear on the site. The collection and processing of personal information through these linked sites are not covered by this privacy policy, and users should carefully review the privacy policies of those linked sites, as any information provided by users to those sites is provided at the users’ own risk, and the Museum is not responsible for privacy policies or data collection and processing actions on those sites.

  1. Marketing Mail.

The Museum offers a service to receive newsletters, updates and various content (among others) by email, SMS messages, mobile messaging apps (such as WhatsApp) or other means (subject to consent under Section 30A of the Communications Law (Bezeq and Broadcasts), 1982). Users who wish to join this service to receive information, updates or various publications from the Museum may provide identifying details (first name, last name and email) and express their consent via the online signup form available here https://forms.motj.org.il/welcome?lang=he. The user may unsubscribe at any time by contacting the Museum at [email protected], or via the unsubscribe mechanism included in every update, message, newsletter, etc.

  1. Users’ Rights (Data Subjects).

Under the Privacy Protection Law, every person has the right to inspect his personal data held in a data bank, either himself or by his authorized representative or by a guardian. If a person finds that his personal information is inaccurate, incomplete, unclear or not updated, he may contact the data bank owner to correct or delete the information. To exercise users’ rights regarding their personal data under the Privacy Protection Law, you may contact the Museum by email [email protected].

  1. For internal purposes only, the Museum may collect date, time, browser type, operating system type, visitor IP address, the page address visited and the referrer page. This information is stored in aggregate form for site management, server load balancing and statistical reporting. User identification based on this information will be performed only in exceptional cases where the Museum believes in good faith that identification is required in light of a danger to life or to prevent serious harm to the health or safety of a user or another person. IP addresses are not linked to personally identifiable details in the Museum’s servers.
  2. Cookies (“Cookies”).
  • The site may use cookies (“Cookies”) (hereinafter: “Cookies“) for its regular and proper operation, including to collect statistical and aggregated data about site usage, verify details, for information security, for advertising and marketing purposes, etc.
  • Cookies are text files created by the user’s browser at the direction of the site’s servers or third-party servers. Some cookies expire when the browser is closed and others are stored on the hard drive of the user’s device. Cookies can contain various information such as preferred language, login details, pages viewed, duration of stay on the site or a specific page, where the user came from, information the user wishes to see upon entering the site, etc.
  • Most browsers’ default setting allows cookies, but modern browsers include an option to block cookies (all or specific types) via browser settings (for example, you can configure the browser to reject cookies or to alert you when cookies are sent to your computer). A user who does not know how to do this should consult the browser’s help file to review how to disable the cookies option. However, note that disabling cookies may prevent full use of the site or other sites or some applications, services and features on the site (or on other sites), or cause some site applications and services not to operate correctly.
  • For your information – The Museum uses essential cookies required for site functioning, performance cookies that enable the Museum to count visits and traffic sources to measure and improve site performance (the data collected by these cookies is aggregate and anonymous), and the Museum may also use third-party cookies from providers such as Google Analytics, social networks (Facebook, TikTok, Instagram, etc.) or other third parties intended to display advertisements and notices about products or services based on users’ activity on the site and/or across the Internet and other sites and services visited, etc. Occasionally, cookies from advertisers or business partners of the Museum may be sent to the user, and it is clarified that the Museum does not control these cookies and is not responsible for them or for any matters related to them.
  1. Information Security.

The Museum takes and implements various security measures in accordance with commonly accepted standards and as required by law. However, as is known, while these measures reduce the risk of unauthorized intrusion and leakage of information, they do not provide absolute security, since storage and transmission of information electronically (including via the Internet) will never be completely secure. Therefore, the Museum does not guarantee that the site will be entirely secure, and by using the site, the user agrees and acknowledges the inherent risks involved.

  1. Data Retention Period.

The Museum will retain personal information for the period necessary to fulfill the purposes set out in Section 8 above, unless a longer or shorter retention period is required or permitted by law.

  1. Changes to the Privacy Policy.

The Museum may periodically change the terms of the Privacy Policy. If material changes are made – a notice will be posted on the site’s homepage 14 days before they come into effect. If non-material changes are made, the policy will indicate the date of the latest update (from which those changes will take effect). Continued use of the site after the privacy policy changes indicates the user’s agreement to the updated/ amended privacy policy. If the user does not agree to the updated/amended privacy policy, he should stop using the site.
